1. Acceptance of Terms

By accessing or using NaijaBargains (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform.

2. Who We Are

NaijaBargains is operated by Jefkim Limited, a company duly incorporated under the laws of the Federal Republic of Nigeria with registration number RC7006460, having its registered office at 71 Kajola Road, Obawole, Ogba, Lagos, Nigeria.

3. Eligibility

You must be at least 18 years old, resident in Nigeria, and legally able to enter into binding contracts to use the Platform. By registering, you warrant that all information you provide is accurate and up to date.

4. Role of NaijaBargains

NaijaBargains is a technology platform that connects buyers and sellers. We are not a party to any transaction between users. We do not own, hold, examine, or ship any listed items. We provide escrow payment infrastructure through Paystack Payments Limited to protect both parties.

5. Escrow Payments

• All escrow-enabled transactions are processed by Paystack Payments Limited, a licensed Nigerian payment processor.
• Buyer funds are held by Paystack (not by NaijaBargains) until the buyer confirms receipt in-app.
• Once the buyer confirms receipt or the auto-release window (24 hours after seller marks delivered) elapses without a dispute, funds are released to the seller.
• NaijaBargains may charge a platform service fee, which will be disclosed on the checkout screen. During our beta launch this fee is 0%.

6. Seller Obligations

• List only items you legally own and have the right to sell.
• Provide honest, accurate descriptions and real photos of the actual item.
• Ship or hand over the item within 3 business days of a paid escrow order, unless otherwise agreed with the buyer in-app.
• Do not list prohibited items (see Section 8).

7. Buyer Obligations

• Inspect items promptly on delivery and either confirm receipt or raise a dispute within the auto-release window.
• Do not abuse the dispute process. Fraudulent disputes may result in account suspension and legal action.

8. Prohibited Items & Conduct

The following items are strictly prohibited on the Platform: firearms, ammunition, illegal drugs, prescription medicines without a licence, counterfeit goods, stolen goods, wildlife and endangered species, human body parts, live animals for slaughter, adult content, and any other items or services prohibited under Nigerian law. NaijaBargains reserves the right to remove any listing and suspend accounts that violate this policy.

9. Disputes

Buyers may raise a dispute at any time before confirming receipt. Our team will review the dispute within 24 hours, may request evidence from both parties, and may release, refund or partially refund the funds based on the evidence. Our decision on disputes is final on the Platform.

10. Limitation of Liability

To the fullest extent permitted by Nigerian law, NaijaBargains and Jefkim Limited shall not be liable for indirect, incidental or consequential damages arising from your use of the Platform, or from the acts of other users. Our total aggregate liability for any claim is limited to the platform fees paid by you to NaijaBargains in the 6 months preceding the claim.

11. Termination

We may suspend or terminate your account at any time for breach of these Terms, fraud, or activity harmful to other users.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via in-app banner or email. Continued use after changes means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes between users and NaijaBargains that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Lagos State.

1. Data Controller

Jefkim Limited (RC7006460), 71 Kajola Road, Obawole, Ogba, Lagos, Nigeria, is the data controller of personal data collected via NaijaBargains.

2. Personal Data We Collect

• Account data: full name, email, phone number, state, password (hashed).
• Listing data: item titles, descriptions, photos, prices, locations you post.
• Transaction data: order references, buyer/seller pairing, timestamps, escrow status.
• Payment data: processed by Paystack. We do not store your full card number, CVV or bank credentials.
• Technical data: IP address, device/browser info, cookies for session management.

3. How We Use Your Data

• To create and operate your account and facilitate transactions between users.
• To process payments, refunds and payouts via Paystack.
• To prevent fraud, resolve disputes and comply with Nigerian law.
• To send transactional emails/SMS (order updates, disputes, security notices).
• With your consent, to send marketing communications (which you can opt out of at any time).

4. Sharing Your Data

We share personal data only with:

• Paystack Payments Limited — to process payments, refunds and transfers.
• Other users on the Platform, only what is necessary to complete a transaction (e.g. your first name and city are visible to a buyer/seller you transact with).
• Law-enforcement agencies where legally compelled to do so.
• We do not sell your personal data to third parties.

5. Your Rights Under NDPA

• Right to access, correct or delete your personal data.
• Right to withdraw consent for marketing at any time.
• Right to data portability.
• Right to lodge a complaint with the Nigeria Data Protection Commission (NDPC).

6. Data Retention

We keep your data for as long as your account is active and for up to 7 years after account closure, as required by Nigerian tax and anti-money-laundering laws.

7. Security

We use HTTPS/TLS encryption in transit, hashed passwords, principle-of-least-privilege access controls, and rely on PCI-DSS-compliant Paystack for card handling. No online system is 100% secure — please protect your password.

8. Cookies

We use essential cookies to keep you signed in and remember basic preferences. We do not use third-party advertising cookies at this time.

9. Children

NaijaBargains is not intended for users under 18. We do not knowingly collect data from minors.

10. Changes

Material changes to this policy will be notified via in-app banner or email.

Escrow Protection Guarantee

When a buyer pays for an item using NaijaBargains escrow, the payment is held by Paystack — not the seller — until the buyer confirms receipt. If something goes wrong, the buyer's funds can be refunded before release.

1. When You Can Get a Refund

A buyer is entitled to a full refund of the item price if any of the following occur before the buyer confirms receipt or the 24-hour auto-release window elapses:

• The seller fails to deliver the item within 3 business days of payment (or the delivery date agreed in-chat).
• The item received is materially different from what was described (wrong model, wrong colour, damaged, counterfeit).
• The item is not delivered at all.
• The seller is unresponsive for more than 48 hours after payment.

2. How to Request a Refund

1. Open the affected order under My Orders.
2. Tap Raise Dispute and describe the problem, attaching photos or chat screenshots where applicable.
3. The seller is notified and has 24 hours to respond.
4. NaijaBargains' dispute team reviews within a further 24 hours (48 hours total) and issues one of: (a) refund to buyer, (b) release to seller, (c) partial refund.

3. Refund Timelines

• Approved refunds are initiated via Paystack Refund API within 24 hours of the dispute decision.
• The refunded amount typically appears in the buyer's card/bank within 5 – 10 business days (this depends on the buyer's issuing bank, not NaijaBargains or Paystack).
• Refunds are always issued to the original payment method.

4. Returns of Physical Items

Return logistics are the responsibility of the parties involved. Where a refund is granted for a mis-described item, the buyer may be required to return the item at the seller's cost using a shipping service both parties agree on. Failure to return the item may result in the refund being reversed.

5. Non-Refundable Situations

• Buyer's remorse (change of mind) after the item has been received and confirmed.
• Items sold with a clear "as-is" or "no-return" statement in the listing description, provided the item matches the description.
• Digital or service transactions where the service has been fully rendered.

6. Chargebacks

If you initiate a chargeback with your bank instead of using our dispute process, NaijaBargains may temporarily suspend your account until the chargeback is resolved. We encourage buyers to use our in-app dispute — it is faster and preserves your account standing.
